Robotic Surgery Injury can be caused by a problem not related to physician error; many complications and injuries can be caused by the a defect in the design of the robot. Robotic da Vinci surgery is most commonly used in hysterectomies and prostate surgeries but it is also used in a wide variety of other surgeries, incluidng gastric bypass, bladder, and thyroid surgeries.
The most common types of Robotic da Vinci surgical injury are bleeding, bowel injury/perforation, and bladder injury.
Defective Robot Causes Injuries
The da Vinci Robot (manufactured by Intuitive Surgery, Inc.) is used for the cutting and cauterizing (burning) of tissues within the body during a variety of surgical procedures. This cutting and cauterizing is done through the use of an electrical current that runs through the robotic instruments. One defect in the Robot is its use of monopolar energy (as opposed to bipolar energy, which is used in your home), which increases the dangers of a variety of injuries. A second defect of the Robot is its inadequate/defective insulation. These Robot design and use defects allow electrical current to pass (and sometimes jump to a distant location) into tissues outside the area being operated on. This means there can be an injury to the bowel, a blood vessel, or other tissue, even in a circumstance where the surgeon is not operating near them. The robot has also had instances of failing to respond to commands and there are concerns about the amount/type of physician training to use the Robot. Unfortunately, injuries are sometimes not detected for until hours, days, or even weeks after surgery. In many cases, long after surgery, patients experience abdominal pain, distention, nausea, fever, vomiting, and/or diarrhea. Without prompt diagnosis and treatment, death can occur.
Complications and Injuries from Robotic Surgery
A variety of complications and injuries can occur from Robotic surgery, including:
- Bowel, colon, intestine, and/or rectum perforation, tears, and/or burns leading to fever, pain, infections, sepsis, peritonitis, and other problems.
- Punctured, torn, or burned blood vessels (vascular injuries to arteries or veins) leading to bleeding.
- Bladder and Ureteral Injuries (including cut or perforated ureters) leading to fever, pelvic pain, blood in the urine, fistula, and/or decreased sexual function.
- Vaginal cuff dehiscence (breakdown).
- Death
These injuries often require additional surgeries to repair the damage and can result in lifelong pain and suffering.
The extensive defects in the Intuitive da Vinci Robot are becoming more evident as more cases are being placed into litigation. Recently, there was an unsuccessful attempt to group all known cases into a large Multi-District Litigation (MDL), but this was denied - at least for now. As more cases are uncovered, there will very likely be another attempt at forming a national MDL, allowing your case to be grouped with many other cases and increasing your chance for a recovery.
